TERMS AND CONDITIONS

1. General Information

  • The Calva Studio online store is operated by P.W. TOMEX mgr inż. TOMASZ TRACZ, ul. Karola NamysÅ‚owskiego 32, 20-709 Lublin, Poland.

  • The Terms and Conditions are available on www.calva.studio at all times and can be saved or printed.

  • Users are responsible for using adequate antivirus and firewall protection when accessing the Online Store.

2. Definitions

  • Client: natural person, business, legal entity, or organization using the Online Store.

  • Consumer: Client as defined by Polish Civil Code, acting for non-business purposes.

  • Entrepreneur: Client acting for business purposes.

  • Goods: products offered in the Online Store.

  • Order: Client’s declaration of intent to purchase Goods.

  • Services: electronic services provided by the Seller, 24/7.

3. Using the Online Store

  • Requires internet access, email, modern browser, and enabled Cookies & JavaScript.

  • Clients must use the Store lawfully, without disrupting operations or sending spam.

  • Content in the Store is for personal use only.

4. Orders & Sales Agreement

  • Orders via the Online Store form, email, or phone are considered offers to conclude a Sales Agreement.

  • The Agreement is concluded once the Seller confirms acceptance via email.

  • Orders require an active email account and necessary personal information.

  • Consumers receive confirmation of their Orders including Terms and Conditions.

5. Delivery & Shipping

  • Domestic delivery via Pocztex within Poland; international shipping upon request via hello@calva.studio.

  • Delivery times are provided on product pages and counted in Business Days.

  • Proof of purchase is provided with each delivery.

6. Prices & Payment

  • Prices are in PLN and include all taxes and fees.

  • Payment is made electronically; orders are processed after payment confirmation.

7. Withdrawal & Returns

  • Consumers can withdraw from the Agreement within 14 days of delivery (not applicable to customized or made-to-order items).

  • Returned items must be in original condition; the Client bears the direct cost of return unless agreed otherwise.

  • Refunds are issued within 14 days using the original payment method.

8. Complaints & Warranty

  • Goods are delivered free of defects.

  • Consumers may claim warranty rights under the Civil Code; Entrepreneurs’ claims are excluded.

  • Complaints must be sent to hello@calva.studio or via phone.

  • Complaints are processed within 14 days; incomplete complaints will be requested for clarification.

9. Electronic Services Complaints

  • Clients may report issues with the Online Store or Services via email or phone.

  • Complaints are processed within 14 days.

10. Out-of-Court Dispute Resolution

  • Consumers can seek assistance via:

    • Permanent consumer arbitration court at the Trade Inspection

    • Regional Trade Inspector mediation

    • Free consumer organizations (e.g., Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich)

    • EU ODR platform: http://ec.europa.eu/consumers/odr/

11. Data Protection

  • Personal data is processed according to the Privacy Policy and applicable law.

12. Final Provisions

  • All intellectual property rights to the Online Store and its content belong to the Seller.

  • Disputes with Consumers: competent courts according to Civil Procedure Code.

  • Disputes with Entrepreneurs: courts with jurisdiction over the Seller’s office.

  • Changes to Terms and Conditions take effect no earlier than 14 days after publication on the website.
